Chaque espace de location est minutieusement d\u00e9cor\u00e9 d\u2019objets uniques et de mobilier ancien, le tout chin\u00e9 et dispos\u00e9 avec soin afin de recr\u00e9er des univers de vie intemporels et cr\u00e9atifs.<\/p><p>Il est primordial de demander l\u2019autorisation pr\u00e9alable au propri\u00e9taire de d\u00e9placer les \u00e9l\u00e9ments de d\u00e9coration ainsi que le mobilier en place. En cas d\u2019approbation de la part du propri\u00e9taire, une personne mandat\u00e9e par celui-ci sera pr\u00e9sent lors de la dite prestation pour aider le locataire au d\u00e9placement des objets ou mobilier en question.<\/p><p>La d\u00e9coration sera replac\u00e9e comme d\u2019origine au d\u00e9part du locataire.<\/p><p>Pour tous autres services additionnels souhait\u00e9s par le locataire, la demande doit en \u00eatre faite aupr\u00e8s du Propri\u00e9taire ou ses repr\u00e9sentants qui, selon le type de demande, pourront se charger d\u2019une mise en relation avec un prestataire ext\u00e9rieur au Ch\u00e2teau de Suscy.<\/p><p><strong><u>2.RESERVATION<\/u><\/strong><\/p><p><strong>2.1. R\u00e9servation <\/strong><\/p><p>Le Contrat liant le Propri\u00e9taire au Locataire ne sera d\u00e9finitif qu\u2019\u00e0 r\u00e9ception du dossier complet retourn\u00e9 au Propri\u00e9taire par le Locataire comprenant\u00a0:<\/p><ul><li>Le contrat de location \u00e9tabli entre le Propri\u00e9taire et le Locataire d\u00fbment sign\u00e9<\/li><li>L\u2019acompte de 50 % du montant de la r\u00e9servation uniquement par virement bancaire (copie de l\u2019ordre de virement)<\/li><li>Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales de Location sign\u00e9es et rev\u00eatues de la mention \u00ab\u00a0Lu et approuv\u00e9\u00a0\u00bb<\/li><li>Un ch\u00e8que de caution de 3.500 \u20ac libell\u00e9 \u00e0 l\u2019ordre du propri\u00e9taire<\/li><\/ul><p>Aucune r\u00e9servation ne sera accept\u00e9e de personnes \u00e2g\u00e9es de moins de 18 ans.<\/p><p>En signant le contrat de location et les pr\u00e9sentes Conditions G\u00e9n\u00e9rales, le Locataire s\u2019engage pour lui-m\u00eame ainsi que tous les occupants du lieu lou\u00e9, pour lesquels il se porte fort et prend la responsabilit\u00e9 de tout r\u00e8glement \u00e9mis par un ou plusieurs cooccupants et qui seraient impay\u00e9s.<\/p><p>Le Propri\u00e9taire se r\u00e9serve le droit d\u2019annuler la r\u00e9servation \u00e0 tout moment, sans pr\u00e9avis et sans aucune indemnit\u00e9 en cas de non-r\u00e9ception du contrat sign\u00e9 par le Locataire et du r\u00e8glement des acomptes.<\/p><p>Tant que la r\u00e9servation n\u2019aura pas \u00e9t\u00e9 confirm\u00e9e, le propri\u00e9taire ou ses repr\u00e9sentants se r\u00e9servent le droit de proc\u00e9der \u00e0 des changements et notamment de corriger toute erreur dans les prix propos\u00e9s ou affich\u00e9s.<\/p><p><strong>2.2. Acompte et r\u00e8glement du solde du prix de la location<\/strong><\/p><p>Toute r\u00e9servation devient ferme et d\u00e9finitive apr\u00e8s versement d\u2019un acompte \u00e9quivalent \u00e0 50 %.<\/p><p><u>\u00a0<\/u><\/p><p>Le solde sera pay\u00e9 par virement bancaire un mois au plus tard avant la date d\u2019effet du contrat.<\/p><p>Toute prestation demand\u00e9e apr\u00e8s le r\u00e8glement fera l\u2019objet d\u2019une facture compl\u00e9mentaire.<\/p><p>Tous frais de virements et\/ou recouvrement restent \u00e0 la charge du Locataire \/ donneur d\u2019ordre qui s\u2019y oblige.<\/p><p>Une r\u00e9servation qui intervient dans le mois pr\u00e9c\u00e9dant l\u2019arriv\u00e9e au Ch\u00e2teau de Suscy doit \u00eatre pay\u00e9e en totalit\u00e9, y compris le d\u00e9p\u00f4t de garantie.<\/p><p><strong>2.3. Services compl\u00e9mentaires <\/strong><\/p><p>Des services compl\u00e9mentaires pourront \u00eatre propos\u00e9s au Locataire, tels que\u00a0la fourniture de repas (petit-d\u00e9jeuner, d\u00e9jeuner), l\u2019accompagnement stylistique de la cr\u00e9atrice Virginie Neumann &#8211; Guarisco lors de l\u2019organisation artistique de photo-shooting.<\/p><p>Un service de transport Paris-Suscy peut \u00eatre mis en place \u00e0 la demande du Locataire.<\/p><p>Le Propri\u00e9taire pourra \u00e9galement s\u2019occuper de la mise en relation du Locataire avec des prestataires ext\u00e9rieurs (traiteur, fleuriste, etc.).<\/p><p>S\u2019agissant d\u2019une simple mise en relation, le Propri\u00e9taire ne saurait voir sa responsabilit\u00e9 engag\u00e9e en cas de difficult\u00e9 dans la relation contractuelle existant entre le Locataire et le prestataire ext\u00e9rieur dont il demeure parfaitement \u00e9tranger.<\/p><p><strong>3.<u>ETAT DES LIEUX ET DEPOT DE GARANTIE <\/u><\/strong><\/p><p>Une reconnaissance pr\u00e9alable de l\u2019\u00e9tat des lieux sera effectu\u00e9e par le Locataire et le Propri\u00e9taire (ou son repr\u00e9sentant) pour constater le bon \u00e9tat des locaux, des installations \u00e9lectriques, du mobilier, des installations sanitaires et de s\u00e9curit\u00e9 contre l\u2019incendie, de la d\u00e9coration et, le cas \u00e9ch\u00e9ant, du mat\u00e9riel mis \u00e0 disposition.<\/p><p>Lors de cet \u00e9tat des lieux, il appartient au locataire de signaler au Propri\u00e9taire ou son repr\u00e9sentant toute anomalie, dommage, d\u00e9gradation, etc. qu\u2019il serait amen\u00e9 \u00e0 constater \u00e0 d\u00e9faut de quoi les lieux seront consid\u00e9r\u00e9s comme r\u00e9ceptionn\u00e9s en bon \u00e9tat.<\/p><p>Le montant du d\u00e9p\u00f4t de garantie est fix\u00e9 \u00e0 TROIS MILLE CINQ CENT (3.500,00) euros pour couvrir des dommages \u00e9ventuels sur le lieu de location (Ch\u00e2teau de Suscy et domaine), sans pour autant que ce montant constitue une limite \u00e0 la responsabilit\u00e9 du Locataire en cas de dommages plus importants. L\u2019entr\u00e9e dans les lieux est conditionn\u00e9e \u00e0 son r\u00e8glement.<\/p><p>Si aucune d\u00e9gradation n\u2019est constat\u00e9e lors de la sortie du ou des locataires ou du groupe et, si toutes les charges restant dues (notamment demandes particuli\u00e8res non r\u00e9gl\u00e9es lors de la r\u00e9servation) ont \u00e9t\u00e9 acquitt\u00e9es, la caution sera directement restitu\u00e9e par le propri\u00e9taire ou ses repr\u00e9sentants dans un d\u00e9lai minimum de QUINZE (15) jours.<\/p><p>Dans les autres cas la caution sera restitu\u00e9e d\u00e9duction faite des r\u00e9parations locatives n\u00e9cessaires ou remplacement de mat\u00e9riels. Un d\u00e9tail des r\u00e9parations effectu\u00e9es et des charges pr\u00e9lev\u00e9es sera envoy\u00e9 au locataire.<\/p><p><strong><u>4.CONSIGNES DE SECURITE ET RESPECT DES LIEUX<\/u><\/strong><\/p><p>Le Locataire s\u2019engage \u00e0 respecter, et \u00e0 faire respecter par les diff\u00e9rents intervenants, les consignes de s\u00e9curit\u00e9 en vigueur dans l\u2019ensemble du domaine. Les acc\u00e8s \u00e0 l\u2019ext\u00e9rieur doivent imp\u00e9rativement rester d\u00e9gag\u00e9s, et les extincteurs doivent rester visibles et accessibles.<\/p><p>Le Locataire s\u2019engage \u00e0 faire respecter l\u2019ordre et la propret\u00e9 des lieux et le bon entretien des mat\u00e9riels mis \u00e0 disposition.<\/p><p>Les prestations et \u00e9v\u00e8nements organis\u00e9s au sein de la propri\u00e9t\u00e9 se d\u00e9rouleront sous la surveillance du Propri\u00e9taire ou de ses repr\u00e9sentants, sans que cela ne constitue un motif d\u2019exon\u00e9ration de responsabilit\u00e9 du Locataire.<\/p><p>L\u2019usage des confettis, cotillons et serpentins est strictement interdit dans les salons, ainsi que dans les espaces ext\u00e9rieurs.<\/p><p><strong>4.1. Espaces ext\u00e9rieurs et parking<\/strong><\/p><p>Pour des raisons de s\u00e9curit\u00e9 et hors stationnements limit\u00e9s dus aux livraisons, les v\u00e9hicules devront \u00eatre stationn\u00e9s sur les places de parking pr\u00e9vus \u00e0 cet effet, situ\u00e9es sous la grange et en face de la d\u00e9pendance.<\/p><p>Les v\u00e9hicules devront \u00eatre lib\u00e9r\u00e9s de tout objet ou v\u00eatement de valeur laiss\u00e9 en \u00e9vidence sur les si\u00e8ges et leur syst\u00e8me de verrouillage activ\u00e9.<\/p><p>Le Propri\u00e9taire d\u00e9cline toute responsabilit\u00e9 en cas de vol ou d\u00e9t\u00e9rioration sur ou \u00e0 l\u2019int\u00e9rieur des v\u00e9hicules.<\/p><p>Le Locataire veillera au respect des espaces ext\u00e9rieurs. En particulier, il veillera \u00e0 ce qu\u2019aucun v\u00e9hicule ne roule et\/ou stationne sur les pelouses.<\/p><p>Il est interdit de cueillir des plantes ou des fleurs dans les jardins.<\/p><p>Le locataire s\u2019interdit de recevoir toute personne dont le comportement est susceptible de porter pr\u00e9judice \u00e0 la bonne tenue du lieu.<\/p><p>Le Propri\u00e9taire se r\u00e9serve le droit d\u2019exclure ou d\u2019interdire toute personne ayant un tel comportement sans que sa responsabilit\u00e9 ne puisse en aucune fa\u00e7on \u00eatre engag\u00e9e \u00e0 l\u2019\u00e9gard du Locataire.<\/p><p><strong>4.2. Livraisons et prestataires<\/strong><\/p><p>Toute livraison doit \u00eatre signal\u00e9e au pr\u00e9alable au Propri\u00e9taire.<\/p><p>Le Propri\u00e9taire doit avoir connaissance des prestataires intervenant \u00e0 la demande directe du Locataire, et notamment l\u2019identit\u00e9 du traiteur et prestataires techniques. Le traiteur et les prestataires \u00e9tant ceux retenus par le Locataire, le Propri\u00e9taire d\u00e9cline toute responsabilit\u00e9 en cas de litiges entre les parties.<\/p><p>L\u2019entretien des espaces traiteurs et des salles lou\u00e9es est \u00e0 la charge du Locataire. A d\u00e9faut, le co\u00fbt de la remise en \u00e9tat sera pr\u00e9lev\u00e9 sur la caution du Locataire.<\/p><p><strong>4.3. Fumeurs<\/strong><\/p><p>L\u2019ensemble des b\u00e2timents est NON-FUMEUR. Il est possible de fumer \u00e0 l\u2019ext\u00e9rieur dans les jardins ou en terrasse, dans le respect des personnes pr\u00e9sentes sur place. Les m\u00e9gots devront \u00eatre jet\u00e9s dans des r\u00e9ceptacles et non sur les sols.<\/p><p><strong>4.4. Enfants<\/strong><\/p><p>Pour des raisons de s\u00e9curit\u00e9 (\u00e9tang, outils de jardinages etc.), la pr\u00e9sence d\u2019enfants sur le domaine lors de la r\u00e9alisation des prestations est vivement d\u00e9conseill\u00e9e au Locataire<\/p><p>Toutefois, les enfants pr\u00e9sents \u00e0 l\u2019initiative du Locataire seront sous la surveillance et la responsabilit\u00e9 des adultes qui les accompagnent.<\/p><p>Le propri\u00e9taire ou ses repr\u00e9sentants, son g\u00e9rant et ses intervenants ne sauraient \u00eatre tenus pour responsables d\u2019accidents graves ou l\u00e9gers qu\u2019ils subiraient.<\/p><p><strong>4.5. Animaux <\/strong><\/p><p>Sauf accord expr\u00e8s du Propri\u00e9taire, les animaux ne sont pas accept\u00e9s dans le Ch\u00e2teau de Suscy, ni sur le domaine.<\/p><p>Le propri\u00e9taire ou ses repr\u00e9sentants sont donc en droit de refuser l\u2019acc\u00e8s de tout animal dans la propri\u00e9t\u00e9.<\/p><p>Le locataire ayant \u00e9t\u00e9 inform\u00e9 sur ce point, il ne pourra en aucun cas contester cette clause et prendra \u00e0 ses frais la garde de son animal aupr\u00e8s d\u2019un organisme sp\u00e9cialis\u00e9 ou quittera la location sans pouvoir pr\u00e9tendre \u00e0 une quelconque indemnit\u00e9 ou \u00e0 un remboursement.<\/p><p>Dans le cas o\u00f9 le propri\u00e9taire ou ses repr\u00e9sentants accepteraient les animaux, le locataire s\u2019engage \u00e0 rendre la location dans un \u00e9tat de propret\u00e9 irr\u00e9prochable, ne laissant en aucun cas appara\u00eetre la pr\u00e9sence d\u2019un animal durant la p\u00e9riode de location.<\/p><p>Toute d\u00e9gradation due \u00e0 des animaux est \u00e0 la charge exclusive du locataire et sera d\u00e9duite de sa caution.<\/p><p><strong>4.6. Feu d\u2019artifice, bougies et feux de chemin\u00e9e<\/strong><\/p><p>Les feux d\u2019artifice, fumig\u00e8nes sont interdits sauf accord expr\u00e8s du propri\u00e9taire.<\/p><p>En tout \u00e9tat de cause, les feux d\u2019artifice sont autoris\u00e9s sous r\u00e9serve d\u2019autorisation pr\u00e9fectorale et municipale (d\u00e9cret 2010-580 du 31 mai 2010), d\u2019\u00eatre annonc\u00e9s deux semaines \u00e0 l\u2019avance aupr\u00e8s du Propri\u00e9taire et d\u2019\u00eatre tir\u00e9s par une entreprise sp\u00e9cialis\u00e9e poss\u00e9dant les assurances et les autorisations n\u00e9cessaires \u00e0 son activit\u00e9.<\/p><p>Aucun feu d\u2019artifice ne pourra \u00eatre tir\u00e9 apr\u00e8s 23h45.<\/p><p>Les \u00e9clairages \u00e0 la bougie sont interdits en int\u00e9rieur. En ext\u00e9rieur ils sont soumis \u00e0 l\u2019approbation expr\u00e8s et sous surveillance du propri\u00e9taire ou de son mandataire.<\/p><p>Les feux de chemin\u00e9e sont strictement interdits dans les \u00e9tages de la propri\u00e9t\u00e9. Dans la biblioth\u00e8que et l\u2019atelier du rez-de-chauss\u00e9e, ils sont soumis \u00e0 l\u2019approbation expr\u00e8s et sous surveillance du propri\u00e9taire ou de son mandataire.<\/p><p><strong>4.7. Nuisances sonores<\/strong><\/p><p>Apr\u00e8s 23h30, le niveau sonore ne devra pas g\u00eaner les habitations riveraines. Le Propri\u00e9taire se r\u00e9serve le droit de limiter le niveau sonore en cas d\u2019exc\u00e8s.<\/p><p><strong>4.8. D\u00e9coration<\/strong><\/p><p>Tout projet concernant la d\u00e9coration, l\u2019am\u00e9nagement et l\u2019installation technique des espaces devra \u00eatre soumis au Propri\u00e9taire pour approbation, ledit accord est toujours exclusif de tous percements de murs, sols et plafonds, d\u2019applications, collages, affichages supposant l\u2019utilisation d\u2019un produit collant sur les murs, sols et plafonds, ainsi que d\u2019agrafages sur les meubles, portes et poutres. A l\u2019issue de la manifestation, le Locataire s\u2019engage \u00e0 retirer toutes les installations afin que les locaux soient restitu\u00e9s dans leur \u00e9tat original.<\/p><p><strong>4.9. Photographies<\/strong><\/p><p>Le Locataire autorise le Propri\u00e9taire \u00e0 prendre des photos de la r\u00e9ception pour sa communication avec l\u2019assurance du respect du droit \u00e0 l\u2019image des personnes pr\u00e9sentes. Tout refus doit \u00eatre notifi\u00e9 par \u00e9crit en bas de cette page avec la mention \u00ab Refus d\u2019utilisation des photos \u00bb.<\/p><p><strong><u>5.ENTRETIEN ET REMISE EN ETAT DES LOCAUX<\/u><\/strong><\/p><p>Le Locataire est responsable de l\u2019entretien des locaux lou\u00e9s et remise en \u00e9tat apr\u00e8s chaque r\u00e9ception. Ces derniers devront \u00eatre remis en \u00e9tat de propret\u00e9, de nettoyage et d\u2019\u00e9vacuation des d\u00e9chets, emballages et autres objets des prestataires et\/ou du Locataire.<\/p><p>Le Propri\u00e9taire peut \u00e9galement fournir sous sa responsabilit\u00e9 un service de nettoyage moyennant un forfait additionnel de 250\u20ac pour une prestation classique.<\/p><p><strong><u>6.ANNULATION PAR LE LOCATAIRE<\/u><\/strong><\/p><p><strong><u>\u00a0<\/u><\/strong><\/p><p>\u00c0 tout moment, le Locataire pourra annuler sa r\u00e9servation, par courrier recommand\u00e9 avec accus\u00e9 de r\u00e9ception dans les conditions suivantes\u00a0:<\/p><ul><li>Annulation plus d\u2019un mois avant la date de r\u00e9servation : le solde du montant n\u2019est pas d\u00fb.<\/li><li>Annulation moins d\u2019un mois avant la date de r\u00e9servation : 50 % du solde du montant est d\u00fb.<\/li><li>Annulation moins de 15 jours avant la date de r\u00e9servation : le solde du montant est d\u00fb.<\/li><\/ul><p>En cas d\u2019interruption de la location avant la fin de la p\u00e9riode contractuellement pr\u00e9vue, aucune restitution de prix ne sera effectu\u00e9e : tout s\u00e9jour commenc\u00e9 est d\u00fb en totalit\u00e9 ; le d\u00e9p\u00f4t de garantie sera rembours\u00e9 conform\u00e9ment aux pr\u00e9sentes Conditions G\u00e9n\u00e9rales.<\/p><p>Quels que soient les dates et les motifs d\u2019annulations,\u00a0les acomptes vers\u00e9s ne seront pas rembours\u00e9s, sauf annulation due au contexte sanitaire.<\/p><p><strong><u>7.ASSURANCES ET RESPONSABILITE<\/u><\/strong><\/p><p><strong>7.1. Responsabilit\u00e9 du Locataire et Assurances<\/strong><\/p><p>Le Locataire demeure responsable de tous dommages que lui, ses pr\u00e9pos\u00e9s, ses propres prestataires et\/ou fournisseurs et leur personnel seraient susceptibles de causer (ex\u00a0: bris, d\u00e9gradations, pertes ou dommages caus\u00e9s \u00e0 la propri\u00e9t\u00e9).<\/p><p>Le Locataire demeure responsable des dommages et\/ou pr\u00e9judice subis par son personnel, celui de ses prestataires et\/ou fournisseurs ainsi que ses propres biens, ceux de ses prestataires et\/ou fournisseurs, de leur personnel, quelle qu\u2019en soit la cause sauf faute\u00a0caract\u00e9ris\u00e9e du Propri\u00e9taire d\u00fbment \u00e9tablie.<\/p><p>Le Locataire renonce formellement \u00e0 tout recours contre le Propri\u00e9taire du fait de dommages et\/ou pr\u00e9judice engageant sa responsabilit\u00e9 telle qu\u2019\u00e9nonc\u00e9e ci-dessus ; en cas de recours du Locataire, de ses invit\u00e9s, prestataires et\/ou fournisseurs envers le Propri\u00e9taire, ce dernier appellera le Locataire en garantie.<\/p><p>Le Locataire accepte d\u2019indemniser le Propri\u00e9taire contre toute r\u00e9clamation, tout proc\u00e8s, toute demande en dommages et int\u00e9r\u00eats, toute action en responsabilit\u00e9, frais et d\u00e9penses, bas\u00e9s sur un fait d\u00e9lictueux et d\u00e9coulant d\u2019un manquement du Locataire ou de ses prestataires ou invit\u00e9s \u00e0 l\u2019une des quelconques clauses du Contrat, d\u2019une faute volontaire ou non, d\u2019une omission du Locataire ou encore de tout dommage caus\u00e9 \u00e0 un tiers par le Locataire ou l\u2019un de ses prestataires<\/p><p>Le Locataire est tenu d\u2019assurer les lieux lou\u00e9s.<\/p><p>Ainsi, au moment de la signature du Contrat, le Locataire fournira une attestation de son assureur de responsabilit\u00e9 civile. Cette attestation devra mentionner les montants assur\u00e9s par rubrique de garantie en pr\u00e9cisant les rubriques o\u00f9 le montant s\u2019applique par sinistre et par ann\u00e9e d\u2019assurance.<\/p><p>En cas d\u2019insuffisance notoire de couverture, restrictions et\/ou limites de garanties de l\u2019assureur du Locataire, le Propri\u00e9taire, apr\u00e8s en avoir avis\u00e9 le Locataire, se r\u00e9serve le droit de souscrire une assurance compl\u00e9mentaire pour le compte du Locataire. Le montant de cette assurance sera d\u00e9bit\u00e9 au Locataire qui devra en r\u00e9gler le montant au moment de la r\u00e9servation.<\/p><p>En raison de l\u2019amplitude des dommages pouvant \u00eatre caus\u00e9s aux lieux, il est demand\u00e9 au Locataire de souscrire une\u00a0assurance ponctuelle\u00a0pour la dur\u00e9e du Contrat.\u00a0<\/p><p>Enfin, il est rappel\u00e9 que les assurances dont il est fait mention ne sauraient relever le Locataire de ses responsabilit\u00e9s telles qu\u2019elles sont \u00e9nonc\u00e9es ci-dessus notamment en ce qui concerne les franchises des assurances qu\u2019il a souscrites et dont il r\u00e9pond financi\u00e8rement.<\/p><p><strong>7.2. Responsabilit\u00e9 du Propri\u00e9taire et Assurances<\/strong><\/p><p>La prestation du Propri\u00e9taire se limite \u00e0 la mise \u00e0 disposition de moyens et non de r\u00e9sultats. Il ne peut garantir les prestations effectu\u00e9es.<\/p><p>N\u00e9anmoins, le Propri\u00e9taire s\u2019efforcera en toute circonstance d\u2019offrir le service le plus performant possible.<\/p><p>Le Propri\u00e9taire d\u00e9clare \u00eatre assur\u00e9 par une police d\u2019assurance Multirisques couvrant ses biens et responsabilit\u00e9s pour les prestations objet du contrat.<\/p><p><strong><u>8.RECLAMATIONS ET CONTESTATIONS<\/u><\/strong><\/p><p><strong><u>\u00a0<\/u><\/strong><\/p><p><strong>8.1. R\u00e9clamations<\/strong><\/p><p>Les \u00e9ventuelles r\u00e9clamations au cours du s\u00e9jour doivent \u00eatre port\u00e9es aupr\u00e8s du propri\u00e9taire ou ses repr\u00e9sentants sur place. Aucune r\u00e9clamation ne sera admise apr\u00e8s le d\u00e9part du Locataire.<\/p><p><strong>8.2. Contestations<\/strong><\/p><p>En cas de contestation sur une partie de la facture, le Locataire s\u2019engage \u00e0 payer sans retard la partie non-contest\u00e9e et \u00e0 indiquer au Propri\u00e9taire le motif de sa contestation qui devra \u00eatre r\u00e9elle et s\u00e9rieuse.<\/p><p>Toute facture qui n\u2019aura pas \u00e9t\u00e9 contest\u00e9e selon la proc\u00e9dure ci-dessus d\u00e9crite, dans un d\u00e9lai de 15 jours \u00e0 partir de la date d\u2019envoi de celle-ci, sera consid\u00e9r\u00e9e comme accept\u00e9e.<\/p><p>Tout montant impay\u00e9 par le Locataire \u00e0 la date d\u2019exigibilit\u00e9 de la facture, \u00e0 l\u2019exclusion de ceux contest\u00e9s dans les conditions pr\u00e9vues ci-dessus, portera int\u00e9r\u00eat au taux de 5 % par mois de retard conform\u00e9ment \u00e0 l\u2019article L.441-6 du Code de commerce.<\/p><p><strong><u>9. NULLITE ET MODIFICATION DU CONTRAT<\/u><\/strong><\/p><p>Si l\u2019une des stipulations du pr\u00e9sent contrat \u00e9tait annul\u00e9e, cette nullit\u00e9 n\u2019entra\u00eenerait pas la nullit\u00e9 des autres stipulations qui demeureront en vigueur entre les parties. Toute modification contractuelle n\u2019est valable qu\u2019apr\u00e8s un accord \u00e9crit et sign\u00e9 des parties.<\/p><p><strong><u>10. PROTECTION DES DONNEES A CARACTERE PERSONNEL<\/u><\/strong><\/p><p><strong>10.1. Collecte des donn\u00e9es personnelles<\/strong><\/p><p>Conform\u00e9ment au R\u00e8glement 2016\/679 du 27 avril 2016 relatif \u00e0 la protection des personnes physiques \u00e0 l&#8217;\u00e9gard du traitement des donn\u00e9es \u00e0 caract\u00e8re personnel et \u00e0 la libre circulation de ces donn\u00e9es, le Bailleur met en place un traitement de donn\u00e9es personnelles qui a pour finalit\u00e9 la d\u00e9livrance des produits et services d\u00e9finis au pr\u00e9sent contrat. Le Locataire est inform\u00e9 des \u00e9l\u00e9ments suivants :<\/p><p><strong>10.2. Utilisation des donn\u00e9es personnelles<\/strong><\/p><p>Les donn\u00e9es personnelles collect\u00e9es aupr\u00e8s des utilisateurs ont pour objectif la location du domaine de Suscy ainsi que la d\u00e9livrance de services tels que d\u00e9finis dans les pr\u00e9sentes Conditions G\u00e9n\u00e9rales.<\/p><p>Les informations demand\u00e9es lors de la commande sont notamment n\u00e9cessaires \u00e0 l&#8217;\u00e9tablissement de la facture (obligation l\u00e9gale).<\/p><p><strong>10.3. Destinataires des donn\u00e9es \u00e0 caract\u00e8re personnel<\/strong><\/p><p>Les donn\u00e9es \u00e0 caract\u00e8re personnel sont destin\u00e9es au responsable du traitement, les services en charge de la s\u00e9curit\u00e9 informatique, le service en charge de la location, ainsi que toute autorit\u00e9 l\u00e9galement autoris\u00e9e \u00e0 acc\u00e9der aux donn\u00e9es personnelles en question.<\/p><p><strong>10.4. Transfert de donn\u00e9es personnelles<\/strong><\/p><p>Aucun transfert hors UE n\u2019est pr\u00e9vu<\/p><p><strong>10.5. Conservation des donn\u00e9es personnelles<\/strong><\/p><p>Les donn\u00e9es personnelles seront conserv\u00e9es pour la dur\u00e9e n\u00e9cessaire aux op\u00e9rations commerciales, et sans que cela puisse exc\u00e9der le d\u00e9lai l\u00e9gal de la prescription commerciale.<\/p><p><strong>10.6.
